These Terms of Service (these “Terms”) set out the conditions under which WIQS (“we,” “us,” or “our”) provides the “WIQS IQ Test” service (the “Service”). By using the Service, you (the “User”) agree to be bound by these Terms.
Article 1 (Application)
These Terms apply to all relationships between us and Users in connection with the use of the Service. By using the Service, Users are deemed to have agreed to these Terms.
Article 2 (Description of the Service)
The Service is an online test that measures a User’s intelligence quotient (IQ), and consists of the following two types of tests.
- Pretest: A free, simplified test that allows you to try the Service on a trial basis. No personal information is required.
- Official Test: A test that provides a formal IQ measurement result. It is currently available free of charge during this service period, but may become a paid service in the future. If we introduce fees, we will announce this in advance on the Site and separately set out details such as pricing and payment methods.
Article 3 (Eligibility)
The Service is available to anyone in principle. If a minor wishes to take the Official Test, they must first obtain the consent of a parent or other legal guardian.
Article 4 (Prohibited Conduct)
When using the Service, Users must not engage in any of the following acts.
- Acts that violate laws, regulations, or public order and morals
- Acts that infringe our or any third party’s intellectual property rights, rights of publicity, privacy rights, or other rights
- Reproducing, republishing, altering, distributing, or selling the Service’s question data, images, or other content without authorization
- Manipulating test results through improper means, or taking a test while impersonating another person
- Acts that destroy or interfere with the functioning of our servers or network
- Acts that may interfere with the operation of the Service
- Any other act we deem inappropriate
Article 5 (Disclaimer Regarding Test Results)
Test results provided by the Service are for reference purposes only and are not intended for medical or psychological diagnosis or official intelligence assessment. We make no warranty as to the accuracy, completeness, or fitness for any particular purpose of the test results. We shall not be liable for any damages arising from decisions or actions taken by Users based on their test results.
Article 6 (Intellectual Property Rights)
Copyrights and other intellectual property rights in the question texts, images, programs, designs, and all other content related to the Service belong to us or to third parties who legitimately hold such rights. Users must not reproduce, republish, alter, or otherwise make secondary use of these without our prior permission.
Article 7 (Disclaimer)
We do not warrant that the Service is free of factual or legal defects (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, and the like, as well as errors, bugs, or rights infringements). Except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages arising from the Service. In addition, the Service may be suspended or interrupted without notice due to communication failures, maintenance, or other unavoidable circumstances.
Article 8 (Changes to or Discontinuation of the Service)
We may change the content of the Service or discontinue its provision without prior notice to Users. We shall not be liable for any damages incurred by Users as a result.
Article 9 (Changes to These Terms)
We may amend these Terms without prior notice to Users whenever we deem it necessary. Amended Terms take effect once posted on the Site, and Users who use the Service after such amendment are deemed to have agreed to the amended Terms.
Article 10 (Governing Law and Jurisdiction)
These Terms shall be governed by and interpreted in accordance with the laws of Japan. Any disputes arising in connection with the Service between us and a User shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
